Just saw this on CNET. Instead of shutting down Napster looks like Judge Patel has appointed a mediator to work this out. Which I take to be significant because everyone thought she was shutting Napster down.

A federal judge has appointed a mediator in the copyright dispute between Napster and major record companies, Newsweek reported.

U.S. District Judge Marilyn Hall Patel, who ruled July 26 that Napster violated copyright laws by allowing users to download songs for free, named former federal judge Eugene Lynch as a mediator, the magazine said.

Lynch has held at least one session with the two sides and has another scheduled, Newsweek said. Napster's plan to turn into a subscription service won't work unless the company can persuade all five major record distributors to join, analysts have said.

Hmmm...Judge Lynch. Well, this guy should please Rene and everybody that wants to lynch all things Napster.
